Unaware of Missed Interview, Rescheduled Within 45 Days

After arriving in the United States, Ms. P consulted an “immigration agency” that boasted a “100% success rate” and entrusted it to file her asylum application. After waiting several years, she finally received a notice from USCIS stating that she had missed her scheduled interview and now had 45 days to explain the reason for her absence, or else her case would be referred to immigration court.

Confused, Ms. P asked an English-speaking friend to check her case status online. To her shock, she discovered that USCIS had sent her an interview notice a month earlier, with the appointment scheduled just the week before. Since she was unaware of the notice, she had failed to attend the interview, and USCIS was now demanding an explanation.

Ms. P confronted the agency, only to hear an infuriating excuse: they claimed they received “too much mail every day” and had simply “forgotten” to forward the notice to her. When she asked them to correct the mistake and explain the situation to USCIS, the agency blamed her for “not knowing English” and even demanded another fee to “help” her respond.

Frustrated and unwilling to be further exploited, Ms. P immediately terminated her relationship with the agency and turned to the Law Offices of Han Shu. Attorney Shu and his professional team acted swiftly, contacting USCIS multiple times by phone and email to explain the circumstances. With their intervention, USCIS acknowledged Ms. P’s situation and granted her a second chance by issuing a new interview notice.
